Planning Approval Decision

With the planning approval decision of the Oberbergischer Kreis, Der Landrat, Moltkestr. 42, 51643 Gummersbach dated 18.02.2026, the plan for the project of Fa. Günter Jaeger Steinbruchbetriebe GmbH, Lüsberger Str. 2, 51580 Reichshof for the expansion of a waterbody after the extension and deepening of the existing quarry at Elbachstr. 11, 51580 Reichshof pursuant to Section 68 of the Water Resources Act – WHG – in conjunction with Section 74 of the Administrative Procedure Act NRW – VwVfG NRW – has been approved.

The plan also includes the areas to be recultivated.

An environmental impact assessment was carried out in the procedure. Conditions were imposed on the project developer.

As far as objections have not been addressed through secondary provisions or otherwise, they are rejected.

The decision establishes the admissibility of the project, including the necessary follow-up measures on other facilities, with regard to all public-law concerns affected by it; in addition to the planning approval, other official decisions, in particular public-law permits, awards, licenses, approvals, consents, and planning approvals, are not required.

The disclosure in the municipality of Reichshof will initially take place through the availability of the decision and the plan documents on the website of the municipality of Reichshof at https://www.reichshof.org/rathaus-service/planfeststellungsbeschluss-guenter-jaeger-steinbruchbetriebe-gmbh-in-reichshof.html from 16.03.2026 to 30.03.2026.

Furthermore, the decision with a copy of the plan documents will be available for inspection from 16.03.2026 to 30.03.2026 at the mayor's office of the municipality of Reichshof, Rathaus, Hauptstr. 12, 51580 Reichshof-Denklingen, Room 110 during office hours Monday to Friday from 8:30 AM to 12:00 PM and Monday from 2:00 PM to 6:00 PM.

At the end of the disclosure period, the decision is also deemed to have been delivered to those affected by the project who have not been served the decision (“other affected parties” within the meaning of Section 74 (4) Sentence 4 VwVfG NRW).
