1. Ordinance supplementing the ordinance on the conditions of carriage and fares for occasional taxi services in the Oberbergischer Kreis (Taxi Tariff Ordinance) of March 31, 2022 (Taxi Tariff Supplementary Ordinance)

1st Regulation to Supplement the Regulation on Transport Terms and Conditions and Transport Charges for Occasional Taxi Services in the Oberbergischer Kreis (Taxi Tariff Regulation) dated 31.03.2022 (Taxi Tariff Supplement Regulation)

Based on Section 51 of the Passenger Transport Act (PBefG) as amended on August 8, 1990 (BGBI. I p. 1690), last amended by the Act of April 16, 2021 (BGBl. I p. 822), in conjunction with Section 4 No. 2 of the Regulation on Responsibilities in the Areas of Public Road Passenger Transport and Rail Transport (ZustVO-ÖSPV-EW) dated June 25, 2015 - SGV. NRW. 92 -, the Oberbergischer Kreis enacts the following regulation pursuant to the urgency decision dated April 28, 2026.

Section 1 Scope

The provisions of Section 1 of the Regulation on Transport Terms and Conditions and
Transport Charges for Occasional Taxi Services in the Oberbergischer Kreis (Taxi Tariff Regulation) dated 31.03.2022 shall apply accordingly.

Section 2 Energy Cost Surcharge

In addition to the transport tariffs calculated under the Taxi Tariff Regulation, a one-time surcharge to compensate for currently high fuel costs in the amount of €1.50 is to be charged per transport order, irrespective of the number of passengers transported, until June 30, 2026.

Section 3 Obligation to Carry the Taxi Tariff Supplement Regulation

The Taxi Tariff Supplement Regulation must be carried in every taxi and made available to the passenger for inspection upon request.

Section 4 Fare Indicator

The transport charges must be displayed by the fare indicator according to the specifications of the Taxi Tariff Regulation. The surcharge under Section 2 must be added to the amount displayed by the fare indicator.

A transport may only commence within the mandatory travel area with a properly functioning fare indicator.

If a malfunction of the fare indicator occurs during the transport journey within the mandatory travel area, a manual calculation of the fare shall take place in accordance with Sections 2 to 4 of the Taxi Tariff Regulation. The surcharge under Section 2 is to be added to the calculated fare.

Section 5 Trip Cancellation

If a trip cannot be carried out after the order has been placed due to reasons attributable to the person ordering the taxi, the double basic fee according to the Taxi Tariff Regulation plus the surcharge under Section 2 must be paid for the trip to the pick-up location, irrespective of the destination to which the trip was ordered.

Section 6 Administrative Offenses

Violations of this regulation may be punished as administrative offenses with a fine of up to ten thousand euros pursuant to Section 61 PBefG, unless they are subject to penalties under other provisions.

Section 7 Final Provisions

This regulation shall come into force on the seventh day after publication in accordance with Section 39 (5) PBefG.

This regulation shall expire on June 30, 2026, unless it has already been repealed or its validity extended by a district council resolution.

Publication Order

The foregoing 1st Regulation to Supplement the Regulation on Transport Terms and Conditions and Transport Charges for Occasional Taxi Services in the Oberbergischer Kreis (Taxi Tariff Regulation) dated 31.03.2022 (Taxi Tariff Supplement Regulation) is hereby publicly announced in accordance with Section 5 of the District Ordinance.

Note:

The violation of procedural or formal provisions of the District Ordinance for the State of North Rhine-Westphalia can no longer be asserted against this regulation after six months from this publication, unless

a) a required approval is missing or a required notification procedure has not been carried out,
b) this regulation has not been properly publicly announced,
c) the district administrator has previously objected to the district council resolution,
d) the procedural or formal defect has been complained to the district beforehand, specifying the violated legal provision and the fact that constitutes the defect.
